Item Transcription:

Know all men by their presents, that I, John W. Eppes, am held and firmly bound unto E. W. Hubard and W. J Eppes, executors of Martha B. Eppes dcsd. in the sum of forty thousand….dollars, for the payment of which sum, well and truly to be made, I bind myself, my heir, executors, and administrators firmly by these presents. Sealed with my seal, and dated this 20th day of Feb. 1864.

The conductor of the above obligation in such, that whenever the said E. W. Hubard and W. J. Eppes, executors as aforesaid, have delivered to the above bound John W. Eppes all the slaves he is entitled to receive under the will of the said Martha B. Eppes dcsd. without making any reservation of slaves for the payment of debts, the land set apart by the will of the testament for that purpose not being available because the same in within the lines of the enemy: Now if the said John W. Eppes shall refund to said executors his own proportion of the debts of the said Martha B. Eppes, dcsd. and the costs attending the recovery of the same, or in default thereof shall surrender to said executors a sufficient number of the slaves, so delivered to him to be sold to pay his due proportion of said debts, then the above obligation to be void, else to remain in full force.
